Ateliers-Saint-Germain.com is a merchant website operated by Ateliers Saint Germain - M.J.C BP 202 - 98 004 - Monaco Cedex.
The general conditions of sale detailed below govern the contractual relations between any user of the site Ateliers-Saint-Germain.com.
Ateliers-Saint-Germain.com reserves the right to adapt or modify at any time the present general conditions of sale. In case of modification, it will be applied to each order the general conditions of sale in force on the day of the order.
The user having validated a command will then be called "buyer". The rights and obligations of the user necessarily applies to the buyer.
It is specified that the products are intended for personal use of the user, without any direct relationship with the professional activity of the user.
The user who would like to buy on the site, declares to have full legal capacity.
Any order of a product proposed on the site assumes the consultation and the express acceptance of these general conditions of sale, without however that acceptance is conditioned by a handwritten signature on the part of the user.
In accordance with the legal provisions, it is recalled that the validation of the order form as specified in Article 4 below, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature and is proof of the entire order and the payment of the sums. Due in execution of said command.
1. Ateliers-Saint-Germain products:
Products offered for sale by Ateliers-Saint-Germain.comAre those on the site, on the day of the site consultation by the user and within the limits of available stocks.
In the absence of product availability, Ateliers-Saint-Germain.com undertakes to inform the user as soon as possible.
In case of unavailability beyond 30 days of a product ordered and paid, the buyer will be informed by e-mail. The cancellation of the order of this product and its refund will then be carried out, the rest of the order remaining firm and final.
Photographs and illustrations accompanying the products on the site do not have contractual value and can not therefore commit the responsibility of Ateliers-Saint-Germain.com.
The buyer is solely responsible for the choice of products, their conservation and their use.
2. The prices set by Ateliers-Saint-Germain:
Prices are indicated in euros. They take into account any reductions as well as the T.V.A., applicable on the day of the order.
Ateliers-Saint-Germain.com reserves the right to change its prices at any time but the Products will be invoiced on the basis of the rates in force at the time of registration of the order unless typography or omission is incorrect and nevertheless subject to the availability of the said Products. The prices indicated do not take into account the shipping and packing costs which will be charged in addition and will be specified to the User when the order is finally validated.
It is specified that any promotions in the form of discount vouchers are valid only for one order per household and over a given period of validity.
3. PROPERTY RESERVE:
The products remain the property of the Ateliers-Saint-Germain.com which reserves, until full payment, ownership of the Products sold, allowing it to regain possession of the said Products. If necessary, any advance payments made by the Purchaser will remain acquired from the Ateliers-Saint-Germain.com as flat-rate compensation, without prejudice to any other actions which he would be entitled to bring against the Buyer.
4.1. REGISTRATION OF A SITE ORDER ATELIERS-saint-germain.com:
The User places his order on the Internet and on the Site. In order to be accepted, the order must bear all information relevant to its processing.
All orders are valid for acceptance of the general conditions, prices and description of the products available for sale.
If the User wishes to place an order, he or she will choose the different Products to which he or she has an interest, and will show the interest by clicking on the "Add to Cart" box.
At any time, the User may:
- obtain a summary of the products he has selected, by clicking on "Your Cart" ;
- continue its selection of Products by clicking on "Continue shopping" and then on the product(s) of its choice ;
- complete your Product selection and order your Products by clicking on "Paypal" or "Order but pay later".
To order the Products he has chosen, after clicking on "Add to Cart", any User will have to identify himself, either by entering his e-mail and password, or by filling in the appropriate form if not. In the latter case, the User will have to complete the exact form available to him or her, on which he or she will include the information necessary for his or her identification, in particular his or her names, first name, postal address and e-mail.
The User is informed and accepts that the entry of these two identifiers (e-mail address and password) is valid proof of his/her identity and his/her consent.
Once the User is identified, he will have to validate the delivery address (as specified in Article 6 below) and then a confirmation of order will appear on the screen.
4.2. THE SUMMARY OF YOUR ORDER:
The User checks his order with the command summary offered on the screen. The User will then be able to pay for his order either by credit card via the secure server of our SMC bank or via paypal.
4.3. PAYPAL/BARNING PAYMENT:
Ateliers-Saint-Germain.com established a secure procedure in partnership with its bank, SMC. This procedure is based on information encryption technology, which is the real reference for secure payment.
At the time of payment, the Buyer records his bank card number and expiry date and the cryptogram number (three-digit number on the back of the bank card) which are immediately encrypted before being sent to the bank of the Ateliers-Saint-Germain.com via the Internet. Thus, no confidential information flows on the network without having been previously encrypted.
Payment will be made, unless the server is not available, immediately via Paypal.
Once the payment is made, an order confirmation email will be sent to the Buyer.
4.4. THE CONFIRMATION OF THE ORDER BY ATEliers-Saint-germain:
Once it has validated its payment, a summary of the Buyer's order will be sent by e-mail, upon receipt of the order form, to the e-mail address indicated by him at the time of the order. This confirmation will include all the elements of the contract between the Parties.
In any event, Ateliers-Saint-Germain.com reserves the right to refuse any order or delivery in the event of an existing dispute with the Buyer, of total or partial non-payment of a previous order by the Buyer, of refusal of authorization to pay by credit card of banking and insurance bodies, of non-payment or partial payment. The responsibility of Ateliers-Saint-Germain.com in no case may be engaged as such.
The Products are shipped with the supporting invoice, to the delivery address indicated by the Buyer by filling in the fields to be filled out when ordering. If the delivery address is different from the billing address, the products are accompanied by a delivery note summarizing the list of products, without mentioning prices.
5.1. DELIVERY:
The delivery times indicated are indicative deadlines from the day following that of the validation by the purchaser of its order and correspond to the maximum time of treatment and delivery of the products. Under no circumstances can they be opposable. Any possible overrun of delay can not give rise to damages, retained or cancellation of the order by the buyer. In the event of delay of delivery from the date initially fixed, the buyer shall report, within 15 days from the date of departure of the product (s), in writing (mail or mail) to the Saint-Germain workshops to allow them to make a Survey of La Poste. This survey can last up to 21 business days. If, during this period, the product is found, it will immediately be rerouted to the address indicated by the buyer in his purchase order. If at the time of delivery, the original packaging is damaged, torn or open, then you must check the status of the items. If they have been damaged, you must refuse the package and note a reserve on the delivery slip (parcel refused because open or damaged).
